Terms and Conditions

These Terms & Conditions apply to purchases made from Ila Kinis, operated by Alma Hilda LLC (“we”, “us”, or “our”).

Please read these terms before placing an order. Nothing in these terms limits your mandatory consumer rights.

2. Our products and services

We offer creative products and services, including artwork, prints, personalised poems, custom commissions, and digital products.

Each product description explains what is included, whether delivery is physical or digital, and any applicable production times or requirements.

Please read the description carefully before purchasing. A digital product does not include a physical item unless expressly stated.

3. Orders and payment

Please provide accurate contact, delivery, and personalisation details when ordering.

Prices and payment currencies are shown on our website. Applicable taxes and delivery charges collected by us are displayed before you complete your purchase.

Payments are processed through Stripe. Full payment is required before we begin producing or dispatching your order, unless otherwise agreed.

Your purchase contract is formed when we send confirmation accepting your order. A payment receipt alone does not necessarily constitute acceptance.

If we cannot accept an order, we will notify you and refund any payment received for it.

If a pricing or product-description error affects your order, we will contact you before proceeding. You may accept the corrected information or cancel for a refund.

4. Personalised orders and commissions

Custom work is created using the information and reference materials you provide.

You are responsible for checking names, spellings, dates, and other details before submitting them. If you notice an error, contact us as soon as possible. We will try to accommodate changes, but changes may not be possible once production has begun.

Any additional charges for requested changes will be agreed with you before the work is carried out. We will correct errors made by us without additional charge.

Our poems and artwork involve creative interpretation. Examples show the general style of our work, but each commission is individual. Minor artistic differences do not necessarily mean an item is defective, provided it meets the agreed description and requirements.

Revisions are included only where stated in the product description or agreed in writing. This does not affect your rights if the work is faulty or fails to meet the contract.

By submitting photographs or other materials, you confirm that you have permission to provide them for the commission. You give us permission to use those materials only as necessary to fulfil your order.

5. Production and delivery

Production and delivery information is provided on the relevant product page or agreed with you before purchase.

For custom orders, production may depend on receiving the information necessary to complete the work. If essential details are missing, we will contact you.

Delivery estimates are not guarantees unless expressly agreed as such. We will notify you of significant delays.

Where applicable consumer law requires delivery within a particular period, those requirements apply. If we cannot deliver within the agreed or legally required period, you retain your legal cancellation and refund rights.

Please contact us promptly if an order is missing, damaged, or delivered incorrectly. Responsibility for goods remains with us until they reach you or someone you nominate, except where applicable law provides otherwise.

For international deliveries, destination-country import duties or handling charges may apply where these are not collected at checkout. Any known additional charges or the possibility of such charges will be disclosed before purchase.

6. Digital products

Digital products are supplied using the delivery method stated in the product description, such as email or a download link.

File formats and any relevant compatibility requirements will be stated before purchase. Please contact us if you cannot access your purchase.

Unless expressly agreed otherwise, digital purchases are licensed for personal, non-commercial use. You may print purchased artwork for your own use or as a personal gift, but may not resell or distribute the digital files.

7. Cancellations and returns

To request cancellation or report an issue, email hello@ilakinis.com, preferably with your order number.

Standard physical products

Where you have a statutory right of withdrawal, including qualifying EU and UK distance purchases, you may cancel without giving a reason within 14 days after receiving the goods.

You must notify us before that period expires and return the goods within 14 days after notifying us.

You are responsible for direct return postage for a change-of-mind return, provided this was disclosed before purchase. We cover necessary return costs for faulty or incorrectly supplied goods.

You may inspect an item as you would in a shop. Where permitted by law, a deduction may apply for diminished value caused by handling beyond what is necessary to establish its nature, characteristics, and functioning.

Personalised physical goods

The statutory change-of-mind withdrawal right generally does not apply to physical goods made to your specifications or clearly personalised.

This exception does not remove your rights where an item is faulty, damaged, or not as described.

Digital content and creative services

Personalisation does not automatically remove cancellation rights for digital content or services.

Where you have a statutory withdrawal right for digital content, it is lost after supply begins only if all applicable legal conditions have been met, including your prior express consent and acknowledgement of that loss.

For services started during a withdrawal period at your express request, a proportionate charge for work completed may apply if you cancel, where permitted by law. The right is lost after full performance only where the applicable consent and acknowledgement requirements have been met.

Agreeing to these terms alone does not replace any separate consent required by law.

8. Refunds and problems with an order

For a valid statutory withdrawal, we will refund payments due without undue delay and within 14 days after receiving your cancellation notice.

For returned goods, we may withhold the refund until we receive the goods or evidence of return, whichever occurs first, where permitted by law.

Refunds include the cost of our least expensive standard outbound delivery where legally required. Additional charges for an upgraded delivery option are not refundable on a change-of-mind cancellation.

Refunds are made to the original payment method unless otherwise agreed, without a refund fee.

If a product is faulty, damaged, or not as described, contact us with details. Photographs may help us investigate but do not replace or restrict your legal rights.

Depending on applicable law and the circumstances, you may be entitled to repair, replacement, correction, a price reduction, or a refund. Statutory guarantees apply independently of our change-of-mind policy.

9. Intellectual property

Copyright in our original poems, artwork, designs, and website content remains with us or the relevant rights holder unless we expressly agree otherwise in writing.

Purchasing an original, print, digital file, or commission does not transfer copyright.

You may display your purchase, give it as a gift, and share photographs of it for personal, non-commercial purposes. Please credit Ila Kinis when sharing our work publicly.

Commercial reproduction, licensing, or use requires our written permission. These terms do not restrict uses permitted by applicable copyright law.

10. Privacy

Our Privacy Policy explains how we collect and use personal information, including information used to fulfil orders and information collected through Meta Pixel.

11. Responsibility and consumer rights

We are responsible for fulfilling our contractual and legal obligations.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or any other liability protected by mandatory law.

Minor differences in screen colour, paper texture, or handmade finish do not alone constitute a defect. This does not excuse a material difference from the product description.

12. Complaints and applicable law

Please send complaints to hello@ilakinis.com so we can investigate and seek a resolution.

Applicable law determines your rights and the courts or dispute-resolution bodies available to you. Our US company registration does not remove mandatory consumer protections that apply in your country.

Nothing in these terms requires you to bring a claim exclusively in Wyoming or prevents you from contacting a consumer protection authority.

13. Changes to these terms

We may update these terms for future purchases. The version in effect when you place your order applies to that purchase unless a change is legally required or agreed with you.

14. Withdrawal notice

You may exercise an applicable withdrawal right by sending any clear statement to hello@ilakinis.com or our business address above.

You may use the following wording, but it is not compulsory:

“I hereby give notice that I withdraw from my contract for the following goods or services.”

Please include your name, address, the goods or services concerned, the order or receipt date, and the date of your notice. Include your signature only if submitting the notice on paper.
