2. Information we collect

Depending on how you interact with us, we may collect:

  • Your name, email address, billing address, delivery address, and telephone number if provided.
  • Order details, payment status, and transaction references.
  • Photographs, stories, names, preferences, and other details you provide for personalised poems or artwork.
  • Messages and correspondence you send us.
  • Account information and order history if you create an account.
  • Technical information, such as your IP address, browser, device information, and security logs.
  • Cookie identifiers and information about your website activity, including pages viewed, cart activity, and purchases.

Most information comes directly from you or your device. We also receive payment updates from payment providers and delivery information from shipping services.

If someone orders a gift for you, we may receive your name, address, and personalisation details from that person.

3. How we use your information

We use your information to:

  • Process payments and fulfil orders.
  • Create and deliver personalised poems and artwork.
  • Answer enquiries and provide customer support.
  • Maintain customer accounts, where available.
  • Keep accounting records and meet legal obligations.
  • Secure our website, prevent fraud, and manage disputes.
  • Measure advertising performance and show relevant advertisements, subject to consent where required.

Where European or UK data protection law applies, we rely on the following legal bases:

Performance of a contract: processing orders and providing the products or services you request.

Legal obligations: maintaining required records and responding to lawful requests.

Legitimate interests: securing our website, handling enquiries, preventing fraud, and establishing or defending legal claims, taking your rights into account.

Consent: using non-essential advertising technologies and undertaking other processing where consent is required.

Providing information is generally voluntary, but we cannot complete an order without the details necessary to process and deliver it.

4. Personalised poems and artwork

We use the photographs, stories, and other material you provide to create your personalised order and handle related requests.

Please provide only information needed for your commission. Avoid sharing sensitive personal information, such as medical details, or unnecessary private information about other people.

We will seek your permission before using your private stories, reference photographs, or identifiable commissioned work in public portfolios, social media posts, or promotional materials.

5. Payments

Payments are processed through Stripe. Information needed to process your payment and prevent fraud is shared with Stripe.

We receive transaction information, such as payment confirmation and limited payment-method details. We do not receive or store your full card number or card security code.

Stripe also processes information for its own purposes, as explained in Stripe’s Privacy Policy.

6. Who we share information with

Our website uses WordPress and WooCommerce.

We share relevant information with providers that support our business, including website hosting and technical support providers, payment processors, email providers, postal and delivery services, and accounting or legal advisers.

For example, a delivery service receives the name and address needed to deliver a physical order.

We also share website activity and technical information with Meta through Meta Pixel, subject to the consent requirements described below.

We may disclose information where required by law or where necessary to establish, exercise, or defend legal claims.

7. Cookies and Meta Pixel

Our website uses cookies and similar technologies to support essential functions, such as shopping carts, checkout, login sessions, and security.

We also use Meta Pixel, an advertising tool provided by Meta, the company behind Facebook and Instagram. It helps us measure the effectiveness of our advertisements, understand actions taken after viewing or clicking an advertisement, and show relevant advertising to people who have visited our website.

Meta Pixel may collect information such as your IP address, browser and device details, cookie identifiers, pages visited, and actions taken on our website, including product views, additions to your cart, and purchases.

This information is shared with Meta, which may associate it with your Facebook or Instagram account and use it to personalise advertising in accordance with its privacy policy.

Where required by law, including for visitors in the European Economic Area and United Kingdom, we obtain your consent before activating Meta Pixel or other non-essential advertising technologies.

You can accept or reject optional cookies and withdraw your consent through our website’s cookie settings. Withdrawing consent does not affect the lawfulness of processing that occurred before withdrawal.

You can also manage cookies through your browser settings. Blocking essential cookies may affect website functionality.

For information about Meta’s processing, retention, international transfers, and privacy controls, please read Meta’s Privacy Policy and Meta’s Cookies Policy.

8. How long we keep information

We retain personal information only for as long as necessary for the purposes described in this policy.

Order and payment records are retained to meet applicable accounting, tax, and legal requirements. Correspondence and commission materials are retained for the time needed to fulfil your order, handle follow-up requests, and resolve potential disputes.

Account information is retained while your account remains active, subject to necessary legal recordkeeping. Technical records are retained for the time needed for security and troubleshooting.

Retention periods are determined by the purpose of the information, applicable legal requirements, and whether it is needed for an unresolved request or claim.

When information is no longer needed, we delete or anonymise it. Information remaining in backups is removed through our backup replacement cycle.

Meta’s retention practices are described in its privacy and cookies policies linked above.

9. International processing

Alma Hilda LLC is based in the United States. Your information may be processed in the United States or other countries where our service providers operate.

Where European or UK data protection law requires safeguards for an international transfer, we rely on an applicable adequacy decision or appropriate safeguards, such as standard contractual clauses.

You can contact us at hello@ilakinis.com for information about the safeguards relevant to your information and how to obtain a copy.

10. Your privacy rights

Depending on your location and applicable law, you may have the right to:

  • Request access to your personal information.
  • Correct inaccurate or incomplete information.
  • Request deletion of your information.
  • Restrict or object to certain processing.
  • Receive your information in a portable format.
  • Withdraw consent where processing relies on consent.
  • Object to the use of your information for direct marketing, including related profiling.

These rights are subject to legal conditions and exceptions. For example, some transaction records must be retained even after a deletion request.

Contact hello@ilakinis.com to exercise your rights. We may request information necessary to verify your identity and will respond within the applicable legal timeframe.

You may also complain to a relevant data protection authority, including the authority where you live, work, or believe a violation occurred. In Portugal, this is the Comissão Nacional de Proteção de Dados (CNPD).

11. Security

We use reasonable technical and organisational measures to protect personal information against unauthorised access, loss, misuse, or disclosure. No online service or transmission method can guarantee complete security.

12. Updates to this policy

We may update this policy to reflect changes to our services, practices, or legal obligations. The current version will appear on this page with its updated date. Where required, we will notify you of significant changes.
